EWeb-Global.com Web Site Terms of Use and Notices

The eWeb-Global.com Web site consists of various Web sites and Web pages operated by eWeb-Global.com and its affiliates. These Web sites will be jointly referred to in this Agreement as "eWeb-Global" and the "eWeb-Global Network." This Agreement applies to the eWeb-Global Network set of Web sites. It is your responsibility to read this agreement in its whole to review the general requirements of the Terms of Use and Notices and additional terms specific to the product or service for which you are now signing up. A hard copy of these Terms of Use and Notices can be obtained from eWeb-Global customer service.

The eWeb-Global Network is provided to you on condition that you accept, without modification the Terms of Use and Notices as specified in this document. When using the eWeb-Global Network you constitute your agreement to these Terms of Use and Notices.

If you choose to use the sites, or accept the products, services or benefits, to which such terms apply, you agree to familiarize yourself with the Terms of Use and Notices, and other terms and guidelines found throughout the eWeb-Global Network and abide by them.

Modification of These Terms of Use and Notices

eWeb-Global.com reserves the right to change the Terms of Use and Notices, at any time. This is immediately effective upon making the modified provisions available on the eWeb-Global Network. It is your responsibility to regularly review these Terms of Use and Notices. Your continued use of the eWeb-Global Network after any changes to the Terms of Use and Notices shall constitute your consent to the changes. eWeb-Global.com does not and will not assume any responsibility to notify you of any changes to the Terms of Use and Notices.

License you Grant to eWeb-Global

Ownership of materials that you supply to eWeb-Global.com in connection with your use of eWeb-Global or your own web site (created by you or on your behalf) will not be claimed by eWeb-Global.com. However, you grant eWeb-Global.com a royalty-free license to use all information that you have supplied to eWeb-Global (including, without limitation, the rights to: distribute, copy, transmit, publicly display, publicly perform, duplicate, revise, translate, sublicense and reformat your supplied information). You also grant eWeb-Global.com the right to publish your name in connection with any such communication. eWeb-Global.com will not pay any compensation to you for the use of the materials provided by you. eWeb-Global.com is under no obligation to post or use any materials you may provide, and may remove such materials at any time at eWeb-Global.com's sole discretion. By posting messages, uploading files, inputting data, submitting any feedback or suggestions, or engaging in any other form of communication with or through any eWeb-Global Web Site, you warrant and represent that you own or otherwise control the rights necessary to do so. Furthermore, you grant eWeb-Global.com the right to use the material, as specified above, and you will defend and indemnify eWeb-Global.com and its suppliers from any third party claim related to a breach of any of the foregoing representations or warranties.

Use of Communication Facilities

The eWeb-Global Network may provide bulletin board services, chat areas, news groups, forums, communities, personal and business web pages, yellow page listings, electronic mail postings and/or other message or communication facilities. The eWeb-Global Network is designed to enable you to communicate with the Internet community via its communication facilities. You agree not to post or transmit any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, profane, hateful, racially, ethnically or otherwise objectionable material of any kind, including, but not limited to, any material which encourages conduct that would constitute a criminal offence, violate the rights of others, or otherwise violate any applicable local, state, national or international law. You will be responsible for, and indemnify and hold harmless eWeb-Global.com, its subsidiaries, divisions, affiliates, agents and representatives against, any claim arising from any material that you post or transmit.

In addition to above acceptable use limitations, you agree that when using an eWeb-Global communication facility, you will not:

Advertise or offer to sell or buy any goods or services, unless the communication facility specifically permits such messages;

Misrepresent, delete or alter any material, author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of material contained in a file that is uploaded via eWeb-Global communication facilities;

Violate any code of conduct or other guidelines that may be applicable for any particular eWeb-Global communication facility;

Reproduce or otherwise collect information about others, including e-mail addresses, without their written consent;

Link the eWeb-Global communication facility to any third party, or otherwise use or mention the eWeb-Global communication facility without prior written consent;

eWeb-Global.com reserves the right, but is not obligated, to review materials posted to a eWeb-Global communication facility and may also remove any such materials at its sole discretion, without prior notice. In addition, eWeb-Global.com reserves the right to terminate your access to any or all of the eWeb-Global communication facilities at any time without notice. Furthermore, eWeb-Global.com reserves the right to terminate or change any eWeb-Global communication facility at anytime.

With respect to the use of the eWeb-Global communication facilities, eWeb-Global.com reserves the right to disclose any information or materials in order to satisfy any applicable law, regulation, legal process or governmental request. eWeb-Global communication facilities may also edit, refuse to post or remove any information or materials, in whole or in part, from the eWeb-Global communication facility at it's sole discretion.

Fees

You hereby authorize eWeb-Global.com to charge your credit card in advance for products, services or facilities subscribed to, by you, or on your behalf that is available through eWeb-Global. You shall be solely responsible for all charges, fees, duties and taxes arising out of your use of eWeb-Global. eWeb-Global.com reserves the right to modify the fees charged for eWeb-Global products and services from time to time, provided that such modifications shall not take effect earlier than thirty (30) days after eWeb-Global.com posts such modifications on the eWeb-Global.com Web site. Amounts not paid by you to eWeb-Global.com when due, may bear interest at the lesser of one and one-half percent (1.5%) per month, or the maximum rate permitted by applicable law. If you want to terminate your agreement or any part of your services provided by eWeb-Global.com you need to notify eWeb-Global.com in writing 30 (thirty) days prior of doing so. It is also your responsibility to notify eWeb-Global if your credit card has expired and to make the necessary changes. Your failure to meet these requirements may result in the disconnection or interruption of your services or facilities.

Links to Third Party Sites

The eWeb-Global Network provides links that may allow you to leave the eWeb-Global Network. You acknowledge that these linked sites are not under the control of eWeb-Global.com and that eWeb-Global.com is not responsible for the content, information or operation of such sites. These sites are provided to you by eWeb-Global.com, only as a convenience, and the inclusion of any link does not imply endorsement by eWeb-Global.com.

Account, Password, and Security

Once you have subscribed to eWeb-Global.com business or partner services, you shall receive a username and password. You are wholly responsible for maintaining the confidentiality of your username and password. You are furthermore responsible for all activities that occur under your account. You may change your password at any time by following instructions on the eWeb-Global website.

You agree to immediately notify eWeb-Global.com of any unauthorized use of your username and password or if any breach of security known to you, has occurred.

Termination

Anyone determined by eWeb-Global.com to have violated these Terms of Use and Notices, may be barred from using the eWeb-Global Network, or from receiving any products, services or benefits from eWeb-Global. In addition, if you violate any of these Terms of Use and Notices, you will forfeit all credits and any other amounts accruing to you (if any) in connection with the eWeb-Global Network.

General

This Agreement is governed by the laws of the State of Maryland, U.S.A. You hereby consent to the jurisdiction of and venue in courts located in the State of Maryland, U.S.A. in all disputes arising out of or relating to the use of the eWeb-Global Network. In addition, you hereby consent to the exclusive jurisdiction of and venue in such courts for any action commenced by you against eWeb-Global.com, (or its affiliates).

You agree that no joint venture, partnership, employment, or agency relationship exists between you and eWeb-Global.com as a result of this Agreement. If any part of this Agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the Agreement shall continue in effect. A printed version of this Agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this Agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

Your use of the eWeb-Global.com services and its affiliate sites is at your own risk. eWeb-Global.com, nor any of its subsidiaries, divisions, affiliates, agents, representatives or licensors shall be liable to you or anyone else for any loss or injury or any direct, indirect, incidental, consequential, special, punitive or similar damages arising out of your access or use of, or your inability to access or use the eWeb-Global.com services. You hereby surrender any and all claims against eWeb-Global.com and its subsidiaries, divisions, affiliates, agents, representatives and licensors arising out of your use of the eWeb-Global.com services and its affiliate sites and the information available thereon.

Unless otherwise specified herein, this Agreement constitutes the entire agreement between the user and eWeb-Global.com and supersedes all previous communications between eWeb-Global.com and the user.
